ALTERNATIVE DISPUTE RESOLUTION WITH NETCOMM JOINT CONCILIATION SERVICE

Please note that if you are a consumer and you have filed a complaint regarding a contract concluded with T-Data S.r.l. ("T-Data S.r.l.") through this Website, but it has not been possible to resolve the dispute involved in the complaint, T-Data S.r.l. will provide you with information regarding the Alternative Dispute Resolution body or bodies for out-of-court settlement of disputes (known as ADR bodies, as described in articles 141-bis et seq. of the Consumer Code), stating whether or not it uses such bodies to resolve the dispute.

We would also like to remind you that a European platform for the online resolution of consumer disputes (so-called ODR platform) has been established. The ODR platform can be consulted at http://ec.europa.eu/consumers/odr/; through the ODR platform you can consult the list of ADR organisations, find the link to their respective websites and initiate an online dispute resolution process for disputes in which he/she is involved.

According to art. 49 par. 1 lett. v) of Legislative Decree No. 206/2005 (Consumer Code), customers intending to resolve a dispute which has arisen with the merchant (i.e. T-Data S.r.l.) can use the Joint Conciliation procedure. The Procedure may be initiated if the consumer, after having filed a complaint with the company, has not received a reply within 45 days, or has received a reply that is not satisfactory to him/her. For any cross-border disputes relating to the application, execution and interpretation of the General Conditions of Sale of T-Data s.r.l governing purchases made on this website, if you habitually reside or are domiciled in a member state of the European Union other than Italy, you may initiate the European Small Claims Procedure established by Council Regulation (EC) No. 861/2007 of 11 July 2007 before the competent court, provided that the value of the claim does not exceed, excluding interest, fees and expenses, EUR 5,000.00 on the date the court of jurisdiction receives the online claim form.

In any case, whatever the outcome of the out-of-court settlement procedure, you are entitled to bring a dispute before the competent ordinary courts and, where the necessary conditions are met, to seek an out-of-court settlement for disputes involving consumer relations, by adopting the procedures set out in Part V, Title II-bis of the Consumer Code.
