ALTERNATIVE DISPUTE RESOLUTION (ONLINE DISPUTE RESOLUTION) – NETCOMM JOINT CONCILIATION
If you are a consumer and have submitted a complaint concerning a contract entered into with T-Data S.r.l. through this website, but the dispute could not be resolved, T-Data S.r.l. will provide you with information regarding the Alternative Dispute Resolution (ADR) entity or entities (as indicated in Articles 141-bis et seq. of the Italian Consumer Code), specifying whether or not it makes use of such entities to resolve the dispute.
Additionally, we remind you that a European platform for online consumer dispute resolution (known as the ODR platform) has been established. The ODR platform is available at: http://ec.europa.eu/consumers/odr/; through it, you can consult the list of ADR bodies, find a link to each of their websites, and initiate an online dispute resolution procedure.
According to Article 49, paragraph 1, letter v) of Legislative Decree No. 206/2005 (Italian Consumer Code), a customer wishing to resolve a dispute with the merchant (i.e., T-Data S.r.l.) may use the Joint Conciliation Procedure. The procedure can be initiated if the consumer, after submitting a complaint to the company, does not receive a reply within 45 days or receives a response deemed unsatisfactory. For any cross-border dispute concerning the application, execution, and interpretation of the General Terms and Conditions of Sale of T-Data S.r.l. for purchases made on this website, if you usually reside or are domiciled in an EU member state other than Italy, you may initiate the European Small Claims Procedure, established by Regulation (EC) No. 861/2007 of 11 July 2007, before the competent court, provided the value of the dispute does not exceed EUR 5,000, excluding interest, costs, and expenses, at the date on which the court receives the claim form.

In any case, whatever the outcome of the out-of-court dispute resolution process, you retain the right to go to a regular court and, where applicable, to seek out-of-court settlement of consumer-related disputes under Part V, Title II-bis of the Italian Consumer Code.
